kloqd ("Company," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy describes how we collect, use, disclose, and safeguard your information when you use our platform at kloqd.com and related services (the "Platform").

By using the Platform, you consent to the practices described in this policy. If you do not agree, please do not use the Platform.

1. Information We Collect

Information You Provide

  • Account information: Name, email address, phone number, city, and password when you register
  • Profile information: Position, skills, hourly rate, bio, availability schedule, and profile photo (Workers); company name, venue type, and contact details (Clients); agency name and fee structure (Agencies)
  • Agreement records: Your acceptance of the Independent Contractor Agreement and Company Policies, including IP address and user agent at the time of signing
  • Shift and work data: Shift applications, clock-in/clock-out timestamps, hours worked, and timecard details
  • Communications: Messages, feedback, and support requests you send to us

Information Collected Automatically

  • Device and browser information: IP address, browser type, operating system, and device identifiers
  • Usage data: Pages visited, features used, timestamps, and referring URLs
  • Location data: City-level geolocation derived from your profile for shift matching and nearby shift recommendations

Information from Third Parties

  • Background check results: When applicable, results from third-party background verification providers
  • Agency data: If you join an agency on the Platform, the agency may provide information about your work history and assignments

2. How We Use Your Information

We use the information we collect to:

  • Operate and maintain the Platform
  • Create and manage your account
  • Match Workers with relevant shift opportunities based on position, location, availability, and pay preferences
  • Process timecards, calculate payments, and generate invoices
  • Send transactional emails (shift confirmations, timecard approvals, onboarding reminders, account notifications)
  • Send re-engagement communications to inactive users (you may opt out at any time)
  • Generate platform analytics and business reports for administrators
  • Detect fraud, enforce our Terms of Service, and maintain platform integrity
  • Comply with legal obligations

3. How We Share Your Information

We share your information only in the following circumstances:

  • Between Platform users: Worker profiles (name, position, skills, ratings, background check status, agency affiliation) are visible to Clients reviewing shift applications. Client company names and shift details are visible to Workers browsing opportunities.
  • With agencies: If you join an agency, your profile information, shift history, and payroll data are shared with your agency administrator.
  • Service providers: We use third-party services to operate the Platform, including Neon (database hosting), Vercel (application hosting), Resend (email delivery), and Inngest (background job processing). These providers access your data only as needed to perform their services.
  • Background check providers: When background checks are initiated, necessary personal information is shared with the verification provider.
  • Legal requirements: We may disclose information when required by law, court order, or to protect the rights, safety, or property of kloqd, our users, or others.
  • Business transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred to the acquiring entity.

We do not sell your personal information to third parties.

4. Data Retention

We retain your personal information for as long as your account is active or as needed to provide services. After account deletion, we retain certain records (agreement acceptances, timecard history, audit logs) as required for legal, tax, and compliance purposes, typically for a period of 7 years.

Anonymized and aggregated data that cannot identify you may be retained indefinitely for analytics and platform improvement.

5. Data Security

We implement industry-standard security measures to protect your information, including:

  • Passwords are hashed using bcrypt before storage — we never store plaintext passwords
  • All data transmitted between your browser and our servers is encrypted via TLS/HTTPS
  • JWT-based session tokens with 8-hour expiration
  • Rate limiting on authentication and API endpoints
  • Comprehensive audit logging of security-relevant actions
  • Role-based access controls restricting data visibility by user type

While we take reasonable precautions, no system is completely secure. We cannot guarantee the absolute security of your information.

6. Your Rights

Depending on your jurisdiction, you may have the following rights:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Update or correct inaccurate information via your profile settings or by contacting us
  • Deletion: Request deletion of your account and associated personal data by emailing staffing@kloqd.com
  • Opt-out: Unsubscribe from marketing and re-engagement emails at any time
  • Data portability: Request your data in a machine-readable format

7. Cookies and Tracking

The Platform uses essential cookies required for authentication and session management. We do not currently use third-party analytics cookies or advertising trackers. If we introduce non-essential cookies in the future, we will update this policy and provide appropriate notice and consent mechanisms.

8. Children's Privacy

The Platform is not intended for users under 18 years of age. We do not knowingly collect personal information from minors. If you believe a minor has provided us with personal information, contact us at staffing@kloqd.com and we will promptly delete it.

9. California Privacy Rights (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act, including the right to know what personal information we collect, the right to request deletion, and the right to opt out of the sale of personal information. As stated above, we do not sell personal information. To exercise your CCPA rights, contact us at staffing@kloqd.com.

10. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via email or Platform notification at least 14 days before they take effect. The "Effective date" at the top of this page indicates when the policy was last revised.
